Terms of Service

Subscapes is operated by Ant Crafted LLC, doing business as Subscapes ("Subscapes," "we," "us"). By creating an account or using Subscapes (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

You must be at least 18 years old to use Subscapes. By creating an account, you represent that you meet this requirement.

Subscapes is a connection platform. We help hosts and renters find each other for short-to-medium term sublets. We are not a broker, escrow service, payment processor, landlord, or party to any agreement between hosts and renters.

All sublet agreements and payments occur directly between users. Subscapes is not responsible for resolving disputes, enforcing agreements, or guaranteeing any user's identity, conduct, or property condition.

You're responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.

You agree to provide accurate, current information about yourself, your listing (if hosting), and your stay intent (if renting). Misrepresenting any of this is grounds for account suspension.

You agree not to: harass, threaten, or discriminate against other users; post false, misleading, or unlawful content; impersonate anyone; collect other users' data without their consent; reverse engineer or interfere with the Platform; or use the Platform for any illegal purpose.

Hosts must follow our Fair Housing Policy (subscapes.co/fair-housing). Listings and messages may not limit who can rent based on race, religion, national origin, immigration status, sex, gender identity, sexual orientation, age, disability, family status, marital status, lawful source of income (including housing vouchers), criminal history, or any other class protected by law.

We may remove content or suspend accounts that violate these rules, with or without notice.

Hosts represent that they have the legal right to sublet the property — including, where required, the landlord's written consent under New York Real Property Law §226-b or equivalent state law. Misrepresenting your right to sublet is a violation of these Terms and may expose you to legal liability outside of Subscapes. Subscapes does not check whether a host has the right to sublet or has landlord consent; that responsibility is the host's alone.

Hosts are solely responsible for complying with every law that applies to their sublet, including short-term rental laws. In New York City, renting most apartments for fewer than 30 consecutive days is illegal unless the host is registered with the City and present during the stay (NYC Local Law 18 and the Multiple Dwelling Law), and advertising such a rental can carry fines. Jersey City, Hoboken and other New Jersey towns have their own short-term rental permits and limits. Subscapes does not verify compliance.

If the unit is rent-stabilized or under local rent control, hosts represent that the rent they charge does not exceed what that law allows (in New York City, the legal regulated rent plus no more than 10% if sublet fully furnished).

Security deposits on Subscapes may not exceed one month's rent. The law treats a deposit as the renter's money while the host holds it. In New York, keep it separate from your own funds (a separate bank account is enough) and return it within 14 days after the renter moves out, with a written, itemized list of any deductions. In New Jersey, keep it in a New Jersey bank account, tell the renter in writing within 30 days which bank holds it, and return it with interest and an itemized list within 30 days after move-out. Subscapes never holds deposits and does not enforce these rules; they are between host and renter.

Renters acknowledge that visiting a property in person (or via verified live video) is the only way to confirm it matches the listing. Subscapes does not inspect listings or guarantee their accuracy.

Subscapes does not process or escrow payments. Hosts and renters arrange payment directly between themselves using their preferred method (Zelle, Venmo, ACH, etc.).

We strongly recommend that no money change hands until both parties have signed an Agreement of Intent through the Platform and both have verified the unit. Subscapes is not liable for fraud, wire theft, or payment disputes that occur outside the Platform.

The Agreement of Intent template provided through Subscapes is a starting point, not legal advice. For a fully binding lease — especially in rent-stabilized units or where local law imposes additional requirements — consult a licensed real-estate attorney.

Subscapes is not a party to any Agreement of Intent and has no obligation to enforce it.

You keep ownership of the photos, videos, and text you post. You give Subscapes a worldwide, non-exclusive, royalty-free license, which we may extend to service providers who help us run the Platform, to host, display, copy, and adapt that content (for example, resizing photos or composing a listing title from your listing details) to operate, improve and promote the Platform, including featuring your listing and its photos in Subscapes marketing such as our website, emails, social media and ads. This license ends when you delete the content, except for copies kept in backups, marketing materials already published, and aggregated or de-identified data described below. You represent that you own the content or have permission to post it.

We may use listing and activity information (such as prices, dates, locations, amenities, photos, and how listings perform) to analyze the market, improve the Platform, and build new features, including pricing suggestions and features powered by machine learning or artificial intelligence. We may share insights only in aggregated or de-identified form that doesn't identify you. We do not sell your personal information, and we do not use your private messages or identity documents to train AI models.

Don't post photos or descriptions copied from another listing or website. If you believe content on Subscapes infringes your copyright, send a notice to copyright@subscapes.co. We respond to valid notices under the Digital Millennium Copyright Act and may remove content and terminate repeat infringers.

Reviews must reflect a genuine experience. You may not write a review of your own listing, post a review in exchange for money, a discount, or anything of value without clearly disclosing it, or pressure someone to change or remove an honest review.

We don't remove or hide reviews because they're negative. We may remove a review that breaks these Terms, for example one that contains hate speech, personal information, or content unrelated to the stay.

Subscapes staff can view and change accounts and listings using internal admin tools. We use that access to help you when you ask (for example, setting up, editing, or adding photos to a listing for you, or creating an account on your behalf), to keep the Platform safe (reviewing reports, removing content that breaks these Terms, investigating fraud), and to fix problems.

We only change your profile or listings when you've asked us to, or when it's needed to enforce these Terms or the law. Every admin change is recorded in an internal log. Staff never see your password.

We may suspend or terminate your account at any time for violations of these Terms, suspected fraud, or to protect other users. You may delete your account at any time from your profile settings.

The Platform is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Subscapes is not liable for any indirect, incidental, or consequential damages arising from your use of the Platform.

Nothing in these Terms limits liability that cannot be limited under applicable law.

We may update these Terms from time to time. Material changes will be communicated through the Platform or by email. Continued use after changes constitutes acceptance.
