Fair Housing Policy

Our commitment

Subscapes is for everyone. Every host who lists on Subscapes agrees to follow federal, New York State, and New York City fair housing laws, and this policy. Breaking it can get a listing removed and an account suspended.

Who is protected

You may not refuse, discourage, charge more, or set different terms for anyone because of their:

  • Race, color, religion, creed, national origin, or citizenship and immigration status
  • Sex, gender, gender identity or expression, sexual orientation, or pregnancy
  • Age, marital or partnership status, or having children (including familial status)
  • Disability, including the need for a reasonable accommodation such as a service or support animal
  • Lawful source of income, including housing vouchers, Section 8, CityFHEPS, and other rental assistance
  • Arrest or criminal history, under NYC's Fair Chance for Housing Act
  • Military status, status as a victim of domestic violence, or any other class protected by law

What your listing can and can't say

Describe the place, not the person. "Quiet building," "third-floor walk-up," "no smoking," and "no pets" are fine. "No kids," "no vouchers," "young professionals," "women only," or "US citizens only" are not, because they limit who can live there.

Subscapes checks listing text for phrases like these before it goes live and will ask you to remove them.

Choosing a renter

Use the same standards for everyone: dates, budget, house rules, and whether you can verify who they are. Don't ask about the protected traits above, and don't ask about criminal history.

If a renter with a disability asks for a reasonable accommodation, such as an assistance animal in a no-pets home, you generally have to say yes.

Shared homes

Some narrow exceptions can apply when you live in the home and are renting a room in it. They are limited and don't apply to renting out a whole apartment. If you think one applies to you, check with a lawyer before relying on it.

If you think a host or listing on Subscapes broke this policy, tell us at support@subscapes.co and we'll look into it. You can also contact the NYC Commission on Human Rights (call 311) or the U.S. Department of Housing and Urban Development.
